I'd have to brush up on my copyright law, but it seems like if that is the TOU for their site then their claim against you would be one for violation of their terms of use (basically a breach of contract), not necessarily for copyright infringement (since it seems like you can make out a fair use defense). If that's the case, good luck to them on trying to prove damages.
