So they're at it again! The 9th Circuit Court of Appeals have ruled today to nullify the good people of California's 2008 vote against homosexual marriage. Judicial tyranny at its very worst.

What do you expect out of the Ninth? I'm surprised it lasted as long as it did.

Democracy is sloppy, and here's a good example of that fact. I'm surprised California voters voted for a ban in the first place.

It's not judicial tyranny at all. This is the entire reason for the federal court system--to balance the votes of the people and prevent majorities from oppressing minorities just because they can. Note that I am not expressing an opinion on whether Prop 8 was oppressive (since I have no desire to enter that debate right now), but I am saying that appeals courts are there to rule on legislation based on that standard. It's the point of tricameral government. Just because 50% +1 says they want a thing doesn't mean they are allowed to have it--see Jim Crowe laws.

That's why we don't live in a democracy, and the reason you state is important. "The tyranny of the majority" is probably as big a danger to liberty as the tyranny of the government.

The majority now support gay marriage anyway: http://www.gallup.com/poll/147662/first-time-majority-americans-favor-legal-gay-marriage.aspx

70% of those 18 to 34 think it should be legal. My bet is that in 5 to 10 years from now it will be legal in almost every state (with maybe a holdout in the deep South).

This. There was never any doubt how this ruling was going to go.

We'll see if the SCOTUS takes it up.
